Standard Terms And Conditions For The Supply Of GROUP Services Online

UK and International Online therapy Legal Terms of Offer

Definitions

In this document the following words shall have the following meanings:

  • CUSTOMER means any individual, partnership, limited company, charity or organisation that from time to

    time purchases Services from the Supplier

  • SUPPLIER means Aligned Mindset Therapy Limited

  • SERVICES means the services specified.

  • The CONTRACT shall mean instructions, confirmed in writing or electronic format, issued and signed by the

    customer or an authorised person on behalf of the customer.

  • PRICE shall mean all charges and expenses that will by invoiced by the Supplier to the customer for the

    services provided

  • TERMS AND CONDITIONS means the terms and conditions of supply set out in this document and any special

    terms and conditions agreed in writing by the Supplier.

Your Acknowledgement and Agreement

By accepting the terms and conditions and booking the Group sessions, you acknowledge and agree to
each of the following as appropriate:
(a) you will receive the Services and are legally entitled to contract with us for the supply of the Services
(b) that your personal details submitted to us on the Order or otherwise are truthful and accurate at the date on which the Services are supplied;

(c) that on occasions Abreactions can occur during therapeutic sessions. “Abreaction” means an emotional release resulting from mentally reliving or bringing into consciousness, through the process of catharsis, a long-repressed, painful experience. (d) that where therapies are supplied at a location chosen by you, you will ensure that the environment is suitably quiet and undisturbed throughout the session during which the Services are provided and any failure to do so will result in the immediate ending of the provision of Services with you remaining liable to make payment to us of the full price;

(e) that we may refuse to provide Services if we reasonably consider that you may benefit from visiting a medical practitioner or immediate medical assistance;
(f) that you will not receive any Services for any form of actual or attempted pain relief without first consulting a medical practitioner;

(g) to you undergoing a session or series of sessions (the number of which have been discussed) which form part of the contract for Services;
(h) that you may need to undergo less or more treatment by way of Services provided than any estimate provided by us depending on how receptive he/she is to such treatment;

(i) that you are fully responsible for safeguarding your valuables during the provision of the Services.
(j) That I often use an NLP technique called “anchoring.” This may during face to face sessions necessitate that as you recall positive emotions from the past, you are touched by me on the knuckle/shoulder. I will always ask for

your permission and that you are comfortable to proceed before they do this. (k) That I use NLP, CBT, Hypnotherapy and Mindfulness.

Description:

Hypnotherapy is a partnership (defined as an alliance, not a legal business partnership) between the Supplier and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential.

General

  • These Terms and Conditions shall apply to all contracts for the supply of Services by the Supplier to the Customer and shall prevail over any other documentation or communication by the Customer

  • In accepting the Aligned Mindset Therapy Limited offer of Zoom based online therapy you accept that the service is governed by English Law irrespective of the country in which the client/s is/are based. Any disputes or disagreements arising from the provision of services under the terms of this engagement will be dealt with accordingly.

  • Our offer of an online session/s to clients outside of the UK may be restricted due to considerations including legal, regulatory and privacy concerns.

  • Any variation to these Terms and conditions shall be inapplicable unless agreed in writing by the Supplier

  • Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the Supplier may be entitled in relation to the Services, by virtue of any statute law or

    regulation

  • Nothing in these Terms and conditions shall affect the customer’s statutory rights as a consumer

    The Service

  • The Customer shall be deemed to have accepted the service by placing an order

  • Aligned Mindset Therapy Limited will not commence work until the customer has accepted these Terms and

    Conditions and completed the contract and any other forms given to the client to complete.

  • The Supplier shall not be liable for failure to complete the work within the proposed timeline if circumstances

    are beyond their control.

  • The parties agree to engage in Weekly or as agreed sessions by Face to face meetings /Zoom sessions. The sessions will last 45 minutes to 1 Hour, unless agreed differently. The Supplier will be available to Client by e-mail and voicemail in between scheduled meetings as defined by the Supplier. Supplier may also be available for additional time, per client’s request on a prorated basis rate of £ 100 an hour (for example, reviewing documents, reading or writing reports, engaging in other client related services outside of session hours).

    Privacy

    Aligned Mindset Therapy Limited offers online individual and Group Sessions via the ZOOM platform which is a secure, confidential and reliable video software platform. Please familiarise yourself with the technical information provided and prepare for the session so you are ready to start on time.

    Although Aligned Mindset Therapy Limited aims to provide the highest practical levels of client confidentiality protection by using end to end encryption and only utilising services that are HIPAA compliant, we regret we are unable to guarantee complete confidentiality under all circumstances. Monitoring or intrusion by state agencies or by computer service providers operating under state direction may in certain jurisdictions pose a threat to client confidentiality. Computer systems are typically designed to share information with others and often ask you to trade convenience for confidentiality. If you are concerned about your privacy we would suggest that you only use private secured networks when possible and avoid shared connections. Turn off or disable any unnecessary applications, particularly those that may frequently connect to the internet and ensure that your computer is regularly checked for computer viruses and spyware.

Sessions should take place in a private setting so as to ensure conversations are not overheard. In the event the therapist deems the setting to not be sufficiently private, the session will be terminated and fees may still be due. Recording sessions without the explicit consent of both therapist and the client/s will be considered as breach of this service agreement.

Payments

  1. The payment for the Service will be as specified either at the time of booking or in the contract which you will be asked to sign prior to start of one to one sessions or group sessions.

  2. Fees are based on the Supplier’s current assessment of costs and are subject to amendment subject to clause 11 – Cancellation and Termination

  3. Payment of the fee shall be in the manner specified in the contract and should be paid upfront and before commencement of the sessions.

  4. The Supplier reserves the right to charge fees on a monthly payment plan if that is what the client prefers as part of the contract.

 

Process of Payment

Once you and the Supplier agree to continue with ongoing weekly Session, session fees are payable in advance of each session.

Payment for Programs offered by Aligned Mindset Therapy Limited will be paid upfront before the commencement of the sessions unless agreed otherwise.

Payment is usually made via PayPal and can be paid by credit or debit cards or by a PayPal account. If you would like to set up a payment plan (only offered on a case to case basis) for your fees please email namita@alignedmindset.co.uk.

Payment can also be made via BACS. Please ask for details.

Weekly Sessions

Online Group sessions are offered weekly and generally will take place at the same day and time. This consistency and regularity of session times is an important aspect of the therapy process.

Cancellation and Lateness Policy

Client agrees that the Group sessions are non refundable.

If the Client is late in logging onto the Group Session then the Supplier will wait for 10 minutes after which the meeting will be locked and they will not be allowed in. If this happens or a participant misses a Group Session then no alternate sessions will be offered.

 

Customer Obligations

To enable the supplier to perform its obligations the Customer shall:

  • Keep agreed appointments In order to meet the necessary timescales

  • Provide the supplier with any information reasonably required by the Supplier

  • Obtain all necessary permissions and consent which will be required before the commencement of the

    services, the cost of which is the sole responsibility of the Customer. In certain circumstances this may include evidence that the customer holds a specific legal status in respect to a related individual and can make decisions in their best interests. E.g. Enduring Power of Attorney

  • Comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties.

  • To keep the camera on during the sessions

  • No to share the Zoom link with any third party.

    Technical Problems

    Should either party experience technical difficulties, we both endeavour to email straight away and/or try to reconnect online as soon as possible. If overall, more than 15 minutes of the sessions has not occurred due to supplier related technical problems we will offer to supplement this time, and if this is not possible, we will agree a reduced rate for that session in proportion to the service received. No Offer for alternate sessions will be made in case of Group Sessions.

    Forms Completion

    • Clients whether one to one or Group may be asked to complete forms prior to your sessions.. A form of ID may be requested for online sessions.
    • Please ensure you have your appointment email with details as how to access your session close at hand
    • Launch the Zoom application and login a few minutes prior to the scheduled start time of your session.

 

Online sessions are not always suitable for everyone and in such cases we will try to recommend more suitable options that you might then wish to explore. 

 

Confidentiality

This Supplier relationship, as well as all information (documented or verbal) that the Client shares with the Supplier as part of this relationship, is bound to confidentiality Code of Ethics, but is not considered a legally confidential relationship (like in Medicine or Law). The Supplier agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Supplier will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: (a) was in the Supplier’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Supplier from a third party, without breach of any obligation to the Client; (d) is independently developed by the Supplier without use of or reference to the Client’s confidential information; or (e) that the Supplier is required by law to disclose.

The session notes and personal information are kept securely.
As a member of CNHC the Supplier will ensure that you receive a professional and quality service

 

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other professionals for training, supervision, mentoring, evaluation, and further Supplier professional development and/or consultation purposes.

 

As a Group Participant we would normally assume that you are in agreement with all conversation that takes place during the sessions is shared between the Group members.

 

As a Group member you will be bound by Confidentiality not to discuss any of the other group members outside of the sessions.

Feedback Forms and Outcome Monitoring

 

We may seek to gather feedback about the effectiveness of our services and will ask you may be asked to complete some questionnaires at certain intervals during the course of your sessions. This will be done by sending you a link via an email, and we would be grateful if you could complete all questionnaires prior to the next session. The therapist will have access to your answers, and your answers will also be collated anonymously so we can look at how helpful our sessions are overall.

 

Access to Your Data

Aligned Mindset Therapy Limited is registered with the information commissioner and all personal data is processed and maintained in accordance with the Data Protection Act.

How long we keep your information for - data retention

Your information is kept for the time necessary to provide the therapy service requested, however outside of this I will hold your details and session notes for a period of [7 years] following the end of treatment to comply with legal obligations that are placed upon me by my insurers. In the case of a child under 13 then records will be kept [7 years] after they reach the age of majority (18). After this date, all data will be securely deleted.

Sharing of data

There may be times where your information needs to be shared with 3rd parties. I will explicitly ask your consent before doing so, and the data will be sent to 3rd parties securely. We will not be selling your data to anyone.

Information will be kept securely and confidentially in line with the data retention policy as stated above.

Lawful basis for processing your information

The lawful basis for my holding and using your information is in relation to the delivery of a contract to you as a Supplier.

Force Majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

Limited Liability:

Except as expressly provided in this agreement, the Supplier makes no guarantees or warranties, express or implied. In no event will the Supplier be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Supplier’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Supplier under this agreement for all services rendered up until the termination date.

This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations.

Governing Law And Jurisdiction

Any disputes or claims arising out of or in connection with these Terms and conditions of Business or the contract shall be governed by and construed in accordance with the law of England and Wales
These Terms and Conditions shall apply to all contracts for the supply of Services by the Supplier to the Customer and shall prevail over any other documentation or communication by the Customer

Acceptable Of Terms

By booking the service/ attending the sessions you will be accepting the Terms and Conditions of Business.
